Falana & Falana Issues the Following Statement: Alex Saab Challenges Indictment in U.S. Court

WASHINGTON, July 07, 2021 (GLOBE NEWSWIRE) — Today, the legal team of Baker Hostetler, representing Mr. Alex Saab, filed their Opening Brief in the United States Court of Appeals for the Eleventh Circuit, challenging a decision by U.S. District Judge in Miami refusing to consider Mr. Saab’s status as a diplomat immune from U.S. proceedings unless and until he personally appears in the United States.

Mr. Saab was unlawfully detained, at the request of U.S. law enforcement authorities, in Cabo Verde, where his aircraft had stopped to refuel. He was, in fact, traveling from Venezuela to Iran on a diplomatic mission, seeking humanitarian assistance in the midst of the COVID-19 pandemic. It is a well established rule of international law that diplomats, traveling from their country of origin to an overseas post, whether as a special envoy like Mr. Saab or as part of a permanent mission, are entitled to diplomatic immunity from arrest or detention. Accordingly, at the instruction of his own government, he has vigorously opposed his extradition to the United States.

Mr. Saab, the subject of a U.S. indictment for alleged wrongdoing in Venezuela and neighboring countries, sought to raise this point with the Miami district judge, who refused to consider his immunity until he agreed to personally appear before the judge in the United States. The judge grounded his decision in the “fugitive disentitlement” doctrine, which is a judge-made rule stating that individuals who have fled the court’s authority cannot raise legal arguments until they have been physically brought before the court.

However, this doctrine does not apply in Mr. Saab’s case because he has never fled the United States or U.S. law enforcement authorities, and has opposed his extradition to the United States because he is a diplomat on mission entitled to immunity. Accordingly, Mr. Saab has appealed the District Judge’s ruling to the U.S. Court of Appeals for the Eleventh Circuit. In his Opening Brief, Mr. Saab has made plain that he is not a fugitive from the United States and that, as Venezuela’s Special Envoy to Iran, he is a diplomatic Head of Mission under the 1961 Vienna Convention on Diplomatic Relations and the United States Diplomatic Relations Act, which implements U.S. treaty obligations under that Convention. In fact, the Eleventh Circuit concluded that Special Envoy’s like Mr. Saab are entitled to immunity in a case decided in 1984, Abdulaziz v. Meto. Dade County, 741 F.2d 1328 (11th Cir. 1984). This case constitutes binding precedent on both the District Judge and the Court of Appeals.

Accordingly, Mr. Saab has asked the Court of Appeals to reject the District Court’s application of the Fugitive Disentitlement Doctrine and to rule that he is entitled to immunity from arrest, detention, and extradition to the United States, dismissing the case against him.

In his address, Asad Umer said that during COVID-19, the government of Pakistan also faced the twin challenges of saving the economy along with the health of the people, due to which the National Coordinating Committee (NCC) and National Command and Operations Center (NCOC) were set up to combat and convey the truth to the people. He said that the government and the military leadership together in the NCOC made the best decisions in the national interest. He said that the NCOC decided on lockdown, hotspot lockdown and smart lockdown based on daily data so that people’s health and economic condition could be improved.

He said that he made all the decisions keeping in view the situation of his country after learning from other countries. He said that the process of vaccination had started and the same laws were applied to all keeping aside the difference between the rich and the poor and even the President and the Prime Minister of Pakistan vaccinated themselves in their own respective turns. He said that keeping in view the lack of resources and poor health facilities to deal with the epidemic, the government has increased the facilities at hospitals.

He said that the use of technology through various applications has made it easier to calculate the number of patients in hospitals, and has ensured availability of oxygen, assessment of the condition of beds and medical facilities. He said that China supported Pakistan in difficult time. He said that through artificial intelligence, the government was formulating a strategy for the future so that an effective and integrated strategy could be formulated to tackle challenges like corona. He appreciated the efforts of the organizers in organizing a meaningful event.

Chinese Ambassador Nong Rong said that since the onset of the corona epidemic, the Chinese government has mobilized its people under the best possible strategy and provided awareness to meet this challenge. He said that scientific research and medical training were promoted on priority basis. He said that to curb the spread of corona an effective smart lockdown was implemented across the country. He said that the Chinese government, realizing its global responsibilities, had supplied 450 million doses of vaccines to various countries and provided other medical supplies in large quantities. He said that long-standing friendly relations with Pakistan were further enhanced during the epidemic.

He thanked the Government of Pakistan for sending medical supplies to China at the beginning of the corona. He said that the Chinese government has so far provided 3.25 million of vaccines and other medical devices to Pakistan. Nong Rong praised the successful strategy of the Pakistani government and the NCOC against corona, saying that effective planning in Pakistan not only prevented the spread of pandemic but also maintained its socio-economic stability.

PU VC Prof Niaz Ahmed said that the steps taken by the government to curb the spread of corona and to improve the economy are commendable. He said that during the pandemic situation when all the universities were closed, Punjab University played its lead role and arranged online classes and examinations so that the education of the students would not be hampered. He said that students were allowed to take physical and online exams and fees were reduced appropriately. He said that PU did not fire any of its employees and even the salaries and other benefits were also paid on time. He said that after taking over the post of Vice Chancellor of Punjab University, with just three years of hard work, Punjab University’s world ranking has improved by 16%, Asian ranking by 54% and for the first time in the history of Punjab University, 13 faculties have been ranked.

He said that various departments of PU have taken steps for the upgrading, welfare and psychology of the people. He said that our media team has done a great job in making the people aware of the excellent performance and the role of Punjab University during the pandemic. He had promised one crore jobs and 50 lac houses but he has made millions unemployed and homeless. The PPP has always brought economic prosperity.

Shaheed Zulfikar Ali Bhutto gave lands to landless and Shaheed Mohtarma Benazir provided jobs. She started the Lady Health Workers programme. President Zardari initiated Benazir Income Support Programme. He also increased salaries by 120 percent, pensions by 100 percent and for the soldiers fighting terrorism by 175 percent. On 25th July the Jiyala Prime Minister will be elected and his first measure will be to increase salaries and pensions.

Chairman PPP said that the PPP confronted the puppet Prime Minister, Imran Khan for the last three years on every front. From the first day we exposed him and called him by his real name “Selected” and he himself thumped the desk. After that the puppet never came to the parliament to hear my speech because he was afraid that he will again thump the desk. We also forgot the bitterness of the past and made an alliance with our political opponents against the puppet. We went to prison to meet them but we should have listened to you people because they did not want to dislodge Imran Khan or Buzdar.

They used to say “Aar Paar” but now are ready to plead them to get into government. We will chase out Imran and Buzdar with the Jiyalas despite the anti-democratic forces siding with them. They wanted to leave the space for Imran Khan but we convinced them to participate in bye-elections and we defeated the puppet from KP to Pishin and from Karachi to Punjab. We defeated Imran Khan to sixth position in Karachi but our friends in opposition started fighting with us. We will not give an inch of space to Imran Khan. We defeated Imran Khan in his own constituency in national assembly and wanted to give him tough time in the budget session but our friends in opposition were absent. He hoped that Shahbaz Sharif and Moulana Fazlur Rehman will issue show cause notices to their absent members.

Chairman Bilawal said that he trusts women wing, PSF and the Kashmir party organisation that the future will be yours if you work hard. The people will support those who confronted Imran Khan and will not support those who left the people on the mercy of Imran’s economic policies. They should come to our stance and only the PPP can chase out Imran Khan and stop any compromise on Kashmir. Imran is lying by saying that he will not provide air bases to the United States because this decision of not providing air bases was taken by the parliament during the PPP government. He said that no one respect Imran Khan and no one even telephones him.
