Islamabad: The recent declaration of Mehmood Khan Achakzai as the Leader of the Opposition in the National Assembly has removed a significant procedural obstacle, facilitating the initiation of appointments to several key constitutional and statutory positions that necessitate consultation between the Prime Minister and the Leader of the Opposition. This development is poised to expedite the appointment process for roles such as the Chief Election Commissioner and members of the Election Commission, among others.
According to Free and Fair Election Network, the notification of the new Leader of the Opposition is crucial for filling various appointments, including the Chairman of the National Accountability Bureau, the Chairperson of the National Commission on the Status of Women, and the Chairperson of the National Human Rights Commission. Additionally, the opposition’s representation on the Judicial Commission of Pakistan and the Parliamentary Committee for appointing the Chairperson of the National Commission for Minorities Rights is contingent on this designation.
The urgency of these appointments is underscored by the fact that the terms of the Chief Election Commissioner and the Election Commission members expired on January 26, 2025. Although Article 215(4) of the Constitution mandates that these appointments be completed within 45 days of the positions becoming vacant, a provision in Article 215(1) allows incumbents to remain until successors are appointed. This has led to the current officeholders continuing their roles nearly a year beyond their term.
Further, the appointment of the NAB Chairman requires consultation with the Leader of the Opposition. The current Chairman’s term will conclude in March 2026, necessitating the initiation of the consultation process two months prior to the expiration of the term, as stipulated by the National Accountability Ordinance 1999.
The position of the Leader of the Opposition had been unoccupied since August 2025 following the disqualification of Omar Ayub Khan. The recent nomination and subsequent notification of Achakzai marks a pivotal step in addressing these outstanding appointments, thereby ensuring adherence to constitutional and parliamentary procedures.
