Islamabad: Senate elections, often held amid political unrest leading to vacancies in the electoral college, remain valid despite these vacancies, according to Section 130 of the Elections Act 2017. This provision is crucial in maintaining electoral integrity, even when disqualifications, resignations, or deaths create vacancies in the National and Provincial Assemblies.
According to Free and Fair Election Network, Section 130 of the Elections Act 2017 ensures that any vacancy within the electoral college does not compromise the validity of Senate elections. This legal measure is particularly significant given the persistent vacancies in Assembly seats in recent years. Nevertheless, the Election Commission retains the authority to postpone elections if it determines that the electoral college is significantly incomplete, as it did during the 2024 Senate elections in Khyber Pakhtunkhwa.
